  137.         'hich the CD Contents are embodied and distributed by'

  142.         '      you. Your exclusive remedy for a breach of this warranty i' +
  143.         's limited to replacement by Imagine of the original'

  162.         'ected. The entire risk as to performance or results of the'

  164.         '      CD and the CD Contents is assumed by you, and neither Imag' +
  165.         'ine nor its third-party suppliers assume any'

  167.         '      responsibility for the accuracy of or any errors or omissi' +
  168.         'ons in the CD Contents, nor shall Imagine or any'

  170.         '      third-party supplier be responsible for file corruption, l' +
  171.         'oss of data, loss of system functionality or other problems'
  172.       '      arising from the use of the CD.'

  174.       '      4. Limited Liability.'

  177.         '      A. In no event, including negligence, shall Imagine or any' +
  178.         ' of its third-party suppliers be liable for any direct,'

  183.         '      Contents, even if Imagine or its third-party suppliers hav' +

  187.         'egoing, neither Imagine nor its third-party supplier shall be'

  189.         '      liable for any loss, damages, or costs arising out of lost' +
  190.         ' profits or lost revenue; loss of use of the CD Contents; loss'

  192.         '      of data or equipment; cost of recovering software, data or' +
  193.         ' the CD Contents; the cost of substitute software, data or'
  194.       '      equipment; or third-party claims relating thereto.'

  197.         '      B. In no event shall the liability of Imagine or its third' +
  198.         '-party suppliers for all damages, losses and causes of action,'
